The legalization wave of cannabis has brought various questions in the minds of people. And the most critical one is about CBD. Does one actually need a Medical Marijuana Card for gaining access to CBD? 

The short and simple answer is yes and no. Confused?

Currently, there are around 40 states that have legalized cannabis either medically or recreationally. And it is expected that this number will continue to grow with a hope that cannabis will also get legalized at the federal level. But until then let’s understand why CBD has a complicated relationship with the possession of marijuana cards.

Only a part of the marijuana plant is illegal according to this act – producers of CBD oil extract from seeds and mature stalk. Now, this makes it legal.

Agricultural Act 2014

Hemp was a powerhouse of the textile industry but back in the 1930s, it got banned since it was associated with the existence of THC and cannabis. But the truth is that the amount of THC present in hemp is not sufficient enough to make you high. And this fact got realized almost 70 years later by the Agricultural Act 2014. This act allows cultivators to grow industrial hemp that has less than 0.3% THC. Thus this hemp is used for extracting CBD oil. 

And if laws are filled properly, hemp-based products can be put up for sale as supplements in the market. And this is why you can easily find CBD products across the country.

Marijuana Derived From Cannabis

Now, learn why you require a 420 card for CBD. Cannabis is still illegal at the federal level but technically CBD is legal. You don’t have any problem buying marijuana-derived CBD products in a recreational state. But in states, where cannabis is medically legalized, you can only buy CBD products if you have a 420 card. And the states where cannabis is completely illegal, then by default CBD products will also be regardless of how they are derived. 

If you are a resident of the state where cannabis is medically legalized, you can get hands-on with marijuana-derived CBD products once you have your own MMJ card. And when it comes to the qualifying conditions for MMJ card, some states are quite liberal. But in states where the conditions are not that liberal, you can opt for buying hemp-derived CBD. Beware, you can get into serious trouble if a concoction has more than 0.3% THC. So, it is vital to read the labels and check the ingredients carefully before using them.
